1. Introduction
Please read these Terms of Use carefully. You declare that you have read and accepted these Terms of Use and Privacy Policy by submitting a command, creating an account, subscribing to a plan, or by accessing or using the website or services. A clear notice indicating effective acceptance is displayed at the time of registration or when sending a command via the "Sign Up" or "Pay" buttons.
It is your responsibility to ensure that the services offered by Frenglish meet your specific needs. By proceeding, you confirm that you have understood the provisions of these Terms of Use and the Privacy Policy.
If you do not meet the conditions specified in these Terms of Use and Privacy Policy, you must not access or use the website or services. If you proceed, you declare that you meet and will continue to meet all required conditions, and that you have read and accepted these Terms.
Any contrary terms proposed by the User shall not be enforceable against Frenglish unless explicitly agreed in writing. The fact that Frenglish does not invoke one of the clauses of these Terms at a given time cannot be interpreted as a waiver of the right to do so later.
2. Definitions
For the purposes of these Terms of Use, the following terms shall have the meanings set forth below, whether used in the singular or plural form:
- "Frenglish" - refers to the company Frenglish Inc., which operates the frenglish.ai platform, including its website, software, services, and documentation.
- "User" - means any individual or legal entity that registers, accesses, or uses the services offered by Frenglish.
- "Website" - refers to the publicly accessible website located at https://www.frenglish.ai.
- "Service" - means the hosted software solution provided by Frenglish for the detection, translation, management, and delivery of multilingual content, including associated APIs, interfaces, and integrations.
- "Account" - refers to the personalized workspace created for the User upon registration, enabling access to the Service and subscription features.
- "Subscription" - refers to the paid plan selected by the User to access the Service, metered by translated word count, seat numbers and plan specific features.
- "Content" - refers to all data, text, documents, and files submitted by the User to Frenglish for translation or processing.
- "Translation" - means the result produced by Frenglish's service, whether by AI translation, human review, or hybrid methods.
3. Purpose
Frenglish Inc. operates the frenglish.ai website and provides its Users with a software-as-a-service (SaaS) solution for the translation and management of multilingual web and document content.
The Service includes, but is not limited to: detection of original content submitted by the User, automatic and assisted translation into supported languages, access to a user dashboard and API, glossary and style guide integration, storage and delivery of translated content, and subscription-based billing tied to word count or accessed features.
These Terms of Use (hereinafter, the "TOU") are intended to define the terms and conditions under which Frenglish provides its Services, as well as the rights and obligations of both Frenglish and the Users.
The User's relationship with Frenglish is also subject to the Confidentiality Policy, accessible at https://frenglish.ai/privacy, which is incorporated by reference into these TOU.
4. Acceptance of Terms
By submitting a command, creating an Account, subscribing to a plan, or accessing the Website or using the Services in any way, the User confirms that they have read and accepted these Terms of Use and the Confidentiality Policy.
This acceptance is deemed effective as soon as the User checks a consent box or clicks a registration or payment button marked with terms such as "Sign Up", "Subscribe", or "Pay", which clearly indicates agreement with the TOU and Confidentiality Policy.`
By doing so, the User acknowledges and accepts all rights and obligations that arise from this agreement, and warrants that they meet all the eligibility and legal requirements to enter into such an agreement.
These TOU form a binding agreement between the User and Frenglish. Any contrary terms proposed by the User shall be unenforceable unless explicitly accepted in writing by Frenglish.
5. Registering on the Website
To access the Services, the User must create an Account by completing the registration process through the Website. Account creation may require the User to provide a valid email address, set a password, and verify their identity via a third-party authentication service.
The User agrees to provide accurate, current, and complete information during the registration process and to keep this information up to date at all times. The Account is personal to the User and may not be shared or transferred without Frenglish's prior written consent.
Access to the Account is protected by secure authentication measures. The User is solely responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their Account.
If the User becomes aware of any unauthorized use of their Account or any breach of security, they must promptly notify Frenglish using the contact information provided in Article 15.
Frenglish reserves the right to suspend or terminate an Account without notice if it determines, in its sole discretion, that the Account is being misused or if the User has violated these Terms of Use.
6. Subscription Conditions
Access to the Services is provided in the form of a subscription (the "Subscription") based on usage volume, measured primarily by the number of words translated and stored.
The Subscription becomes active on the date of initial registration, or at the conclusion of any applicable free trial period, and is subject to the successful payment of the applicable fees through our secure payment provider, Stripe.
Subscriptions are offered on a recurring basis, either monthly or annually, depending on the plan and billing frequency selected by the User at the time of registration. The Subscription will automatically renew for successive periods of the same duration unless canceled in accordance with these Terms.
Users may cancel their Subscription directly from their account settings at any time. Cancellation will be effective at the end of the current billing period. No refunds will be issued for partial periods or unused credits, except where required by law.
Frenglish may cancel a User's Subscription at any time without cause by providing at least thirty (30) days' prior notice via email. In the event of a breach of these Terms of Use or the Confidentiality Policy, Frenglish may suspend or terminate the Subscription immediately.
Upon cancellation or expiration of the Subscription, the User's Account will be deactivated, and all associated data, including stored translations, may be permanently deleted. It is the User's responsibility to export any data prior to cancellation or termination.
7. Financial Conditions
7.1 Payments
Users may subscribe to the Services by selecting one of the available plans described on the Website. Each plan varies based on usage volume, number of team member seats, support level, billing frequency and other features.
7.1.1 Price
The applicable price for each Subscription plan is listed on the Website. Pricing is determined based on the number of words translated, language support, project domains, and support level. Pricing is exclusive of applicable taxes unless otherwise stated.
7.1.2 Billing Frequency and Plan Changes
Users may choose between monthly and annual billing frequencies. This preference may be changed at any time from the User's account settings. Plan changes will trigger prorated charges or credits automatically calculated by Stripe.
Users may also upgrade or downgrade their Subscription at any time. If the User exceeds their plan limits, Frenglish may automatically migrate them to a higher tier following email notification. Prorated billing adjustments will apply based on the time remaining in the current billing cycle.
7.2 Price Adjustments
Frenglish reserves the right to adjust pricing and payment policies at any time. Updated pricing will take effect upon renewal. Users who do not agree to the new pricing must cancel their Subscription before the renewal date. Continued use of the Service after a price update constitutes acceptance of the new rates.
Any discount, promotional rate, or special pricing is granted at Frenglish's sole discretion and does not establish a right to similar pricing in the future.
7.3 Payment Terms
All payments are processed through Stripe. By using the Service, the User agrees to Stripe's Terms of Service. Stripe ensures secure, encrypted transactions. Frenglish does not store any User payment information.
Subscriptions are billed in advance for each billing period. Additional services such as one time bulk translations are billed at the time of purchase. Users authorize Frenglish to use Stripe to automatically charge their selected payment method.
7.4 Late Payments and Payment Issues
In case of payment failure or delay, all outstanding amounts shall become immediately due. Frenglish may suspend or restrict access to the Services until full payment is received. Late payments may incur interest at a rate of 1.5% per month on the overdue amount and a fixed administrative collection fee of CAD $60.
7.5 Refund Policy
Refunds may be requested within fifteen (15) days of the original Subscription purchase by contacting support@frenglish.ai. Refunds do not apply to renewals, upgrades, or partially used Subscription periods. If any usage has been consumed during the Subscription period (e.g., translated words), the refundable amount will be prorated accordingly. For example, if 10,000 out of 30,000 words included in the plan have been used, the refund will cover only the unused portion (20,000 words).
7.6 Right of Withdrawal Exclusion
As Frenglish provides immediate access to digital services upon activation, the User acknowledges that their right of withdrawal is waived once the Subscription has begun, in accordance with applicable consumer protection laws.
8. Personal Data
To provide access to the Services, Frenglish collects and processes a limited amount of personal data from Users. This data includes your email address, name, authentication credentials (managed via a third-party provider), and translation activity (such as original and translated content).
We use this information solely to deliver, maintain, and improve our Services, and to manage user access and billing. Frenglish does not sell or share personal data with third parties, except with trusted sub-processors who assist us in operating the platform (e.g., authentication and payment providers).
Use of the Services constitutes your consent to this limited data processing. More information about how we collect, store, and use data—including your rights to access, correct, or delete your personal information—can be found in our Privacy Policy at https://frenglish.ai/privacy.
If you submit a data request (e.g., access or deletion), please contact us at support@frenglish.ai. For verification, we may require proof of identity before processing the request.
In accordance with applicable privacy laws including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, the General Data Protection Regulation (GDPR), Frenglish acts as the data controller with respect to personal account information. Frenglish acts as a processor only for translation content provided by the User.
If a User's project remains inactive for more than six (6) months—defined as no translation activity, payment or API usage—the project data may be flagged for deletion. Users will be notified prior to deletion and may request recovery within an additional three (3) month period.
9. User Conduct and Restrictions
Users are expected to use the Services provided by Frenglish in a responsible, lawful, and ethical manner. By accessing the platform, Users agree not to misuse the Services, interfere with platform functionality, or engage in activities that may harm Frenglish, other users, or third parties.
- Engaging in unlawful, harmful, or fraudulent behavior using the Service
- Attempting to reverse-engineer, replicate, or exploit the Frenglish platform or translation models
- Transferring, reselling, sublicensing, or assigning access to the Service to third parties without written consent
- Uploading content that infringes on intellectual property rights or violates applicable law
- Creating multiple accounts to bypass usage limits or exploit free tiers
- Using the Service for any purpose other than translation or content management
Frenglish reserves the right to suspend or terminate a User's access to the Service without notice if there is a suspected violation of these Terms, applicable laws, or if behavior poses a risk to the integrity or security of the platform.
Users agree that they are solely responsible for the content they upload or translate and for all activities carried out under their Account. Frenglish assumes no responsibility for content submitted by Users and reserves the right to remove or block access to any content that violates these Terms.
Users agree to cooperate with Frenglish in the event of a third-party complaint arising from their use of the Service. While Frenglish does not impose broad indemnification obligations, it reserves the right to seek reimbursement of reasonable legal costs in cases of willful misconduct or confirmed abuse of the Service.
10. Changes to Terms
Frenglish reserves the right to amend these Terms of Use at any time. In such a case, Users will be notified through the Website or by email in advance of any material changes.
Amended Terms become effective upon the renewal of the User's Subscription or after a notice period of thirty (30) days, whichever occurs first.
If the User does not agree to the revised Terms, they must cancel their Subscription before the effective date. Continued use of the Service after that date constitutes acceptance of the revised Terms.
11. Legal Jurisdiction and Dispute Handling
These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada.
In the event of a dispute arising from these Terms of Use, the User may seek to resolve the issue amicably by contacting Frenglish customer support. If no resolution is reached, the User may pursue mediation through a recognized Quebec mediation body or initiate legal proceedings in the courts of the Province of Quebec, District of Montreal, which shall have exclusive jurisdiction.
These dispute resolution procedures do not limit a consumer's right to pursue recourse with the Office de la protection du consommateur (OPC) in Quebec, where applicable.
12. Limitation of Liability
To the maximum extent permitted by law, frenglish.ai and its affiliates will not be liable for any indirect, special, incidental, or consequential damages (including, but not limited to, loss of profits, data, or business interruption) arising out of or in any way connected with the use of or inability to use the service, even if frenglish.ai has been advised of the possibility of such damages. In no event shall frenglish.ai's total liability to the user for all damages, losses, and causes of action exceed the amount paid by the user for the service during the three (3) months immediately preceding the event giving rise to the liability.
13. Governing Law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.
Any dispute shall be resolved exclusively in the courts of Quebec, Canada.

15. Effective Date
These Terms of Use are effective as of February 13, 2025.
These Terms remain in effect for as long as the User accesses or uses the Services. Frenglish reserves the right to update or modify these Terms at any time, with reasonable notice provided before changes take effect unless required sooner by legal or regulatory obligations.
It is the User's responsibility to review the most current version of the Terms regularly.
